Cannot Curse in high tier maps

I am trying to use Hand of Chayula with Despair and it works on tier 7 maps but not tier 13+, is there some Curse resistance or immunity in higher tiers I am unaware of?

Really want to use Chaotic Freeze as a Acolyte of Chayula to get cheap Freeze effects for bossing, please note I am using Decaying Hex as well to enable it. I have also tried hard casting Despair to no success in higher tier maps too.

Its not a great build, but its mine and this is a bit of a hiccough in it.
